1. Introduction and Acceptance

Welcome to Banzik, a trading name of Go Zazoo Ltd. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Go Zazoo Ltd, a company registered in Cyprus (HE 461195), acting as an Electronic Money Distributor (EMD) and authorized agent of FinXP Ltd.

FinXP Ltd (C 65783) is a licensed Electronic Money Institution regulated by the Malta Financial Services Authority (MFSA) and is headquartered at Ardent Business Centre, No. 4, Triq L-Oratorju, Naxxar NXR 2505, Malta.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Account Services and Limitations

2.1 EUR-Only Accounts

All banking accounts offered by Banzik are denominated in Euros (EUR) only. We do not currently offer multi-currency accounts or accounts in other denominations.

2.2 Private Banking Services

Our private banking services include but are not limited to:

  • Dedicated relationship management
  • SEPA instant transfers and standard transfers
  • Mastercard Elite debit card services
  • Crypto-fiat integration and conversion services
  • Digital asset custody solutions
  • Tax reporting and compliance tools

2.3 Eligibility Requirements

To qualify for our private banking services, you must meet our minimum asset requirements and complete our comprehensive onboarding process, including identity verification and source of funds documentation.

3. Client Responsibilities and Obligations

3.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Implementing strong authentication measures
  • Promptly reporting any unauthorized access or suspicious activity
  • Keeping your contact information and personal details current

3.2 Compliance Requirements

You agree to:

  • Provide accurate and complete information during onboarding
  • Comply with all applicable laws and regulations
  • Not use our services for illegal activities or money laundering
  • Cooperate with our compliance and due diligence procedures

4. Digital Asset and Crypto Services

4.1 Crypto-Fiat Integration

Our crypto services include real-time conversion between digital assets and EUR, institutional-grade custody solutions, and integrated portfolio management. These services are subject to additional terms and regulatory requirements.

4.2 Risk Disclosure

Digital assets are highly volatile and carry significant risks. Past performance does not guarantee future results. You acknowledge understanding these risks before engaging in crypto-related transactions.

5. Fees and Charges

5.1 Transaction Fees

  • SEPA Instant Transfers: Free for amounts up to €100,000
  • Standard SEPA Transfers: Free for all amounts
  • International Transfers: 0.5% fee (minimum €50, maximum €250)
  • Crypto Conversion: Competitive market rates plus processing fees

5.2 Account Maintenance

Private banking clients enjoy preferential fee structures. Detailed fee schedules are provided upon account opening and may be updated with notice.

6. Limitation of Liability

To the maximum extent permitted by law, Go Zazoo Ltd and FinXP Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from these Terms or our services shall not exceed the amount of fees paid by you in the twelve months preceding the claim.

7. Regulatory Framework

7.1 Licensing and Regulation

Our services are provided under the regulatory oversight of the Malta Financial Services Authority (MFSA). We maintain compliance with European banking regulations and electronic money directives.

7.2 Client Fund Protection

Client funds are segregated from operational funds and held in accordance with regulatory requirements. We maintain appropriate insurance coverage and comply with European deposit protection schemes where applicable.

8. Account Termination

8.1 Termination by Client

You may terminate your account at any time by providing written notice. Upon termination, we will process the return of your funds according to regulatory requirements and these Terms.

8.2 Termination by Banzik

We reserve the right to terminate accounts for violations of these Terms, regulatory compliance requirements, or risk management purposes, with appropriate notice where required by law.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malta. Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Malta, except where prohibited by applicable consumer protection laws.

For disputes involving amounts under €10,000, clients may choose to pursue resolution through the Financial Services Tribunal or other appropriate consumer dispute resolution mechanisms.

10. Amendments and Updates

We may update these Terms from time to time to reflect changes in our services, regulatory requirements, or business practices. Material changes will be communicated with appropriate notice.

Continued use of our services after such amendments constitutes acceptance of the revised Terms.
